Question 49: To ask the Minister for Justice, Equality and Law Reform his position on the EU data retention directive recently passed by the European Parliament; if he intends to take a legal challenge against the EU Commission and Parliament in respect of the directive; and if he will make a statement on the matter. The draft directive to which the Deputy refers has yet to be adopted. The question of any legal challenge that might be brought by Ireland in respect of this instrument would be determined on the basis of advice provided by the Attorney General and approval by the Government.
