Question 46: To ask the Tánaiste and Minister for Health and Children her views on the Health Service Executive north east's frustration of the rights commissioner's clear cut recommendation of a person (details supplied) for a permanent post in the Health Service Executive north east region, by its appealing the decision on grounds that were comprehensively dealt with in the rights commissioner's ruling; and if she will make a statement on the matter. Rights commissioners investigate trade disputes referred by individuals or small groups of workers. Having carried out an investigation, the rights commissioner issues a recommendation — which is not binding on the parties involved — giving his or her opinion on the merits, or otherwise, of the dispute. The rights commissioner does not seek to impose a solution on the parties to a dispute but to assist them in arriving at a solution. Ultimately, responsibility for the settlement of a trade dispute rests with the parties to the dispute. In this case the parties are the Health Service Executive north eastern area and the individual concerned. Accordingly, my Department has requested the parliamentary affairs division of the executive to arrange to have this matter investigated and to have a reply issued directly to the Deputy.
