Question 1161: To ask the Minister for Justice, Equality and Law Reform if section 5 of the Arbitration Act 1980 will be reviewed as under the present legislation there is not recourse to the courts in the event of a party to an arbitration being dissatisfied with the arbitrator's decision; and if he will make a statement on the matter. It is an essential characteristic of the arbitration process, in this jurisdiction as in others, that the decision of the arbitrator is intended to be final and binding upon the parties. This does not, however, preclude a limited, supervisory role for the courts in certain circumstances. I have no plans to amend the law to effect a change in this position.
