Question 297: To ask the Minister for Justice, Equality and Law Reform the extent to which he has studied the most recent documentation submitted in connection with an application for refugee status in the case of a person (details supplied) in County Meath; and if he will make a statement on the matter. The applicant in question made an application for permission to remain in the State on the basis of being the parent of an Irish born child born before 1 January 2005, under the revised arrangements announced by me on 15 January 2005. One of the conditions of the revised arrangements is that the parent concerned be continuously resident in the State with the Irish born child since his or her birth. Applicants are required to provide satisfactory evidence of continuous residence.

The baby in question was born in July of 2003 and the applicant made her application for permission to remain in the State under the revised arrangements on 14 March 2005.

The applicant failed to provide satisfactory evidence of continuous residence in the State between June 2004 and February of 2005 and was therefore refused permission to remain in the State under the revised arrangements. The applicant was informed of this decision on 3 October 2005.
