Question 445: To ask the Minister for Education and Science if her Department, through a compulsory purchase order, have the power to extinguish the right of way where a site for a school has been identified with an existing right of way; and if she will make a statement on the matter. [38869/05]

My Department does not have the authority to use compulsory purchase orders in relation to matters arising from site acquisitions. However, sites acquired by my Department are subject to legal examination in order to ensure that there are no title issues which could affect the development of an educational facility on the site.
