Question 435: To ask the Minister for Education and Science if the board of management of a school or her Department are the employer with regard to the transitional agreement 2005 under the Protection of Employees (Fixed Term Work) Act 2003. [38807/05]

The transitional agreement 2005 for the implementation of the Protection of Employees (Fixed Term Work) Act 2003 in the educational sector applies to persons falling within the remit of the Teachers Conciliation Council and the Institutes of Technology Industrial Relations Forum. Under the Education Act 1998, the boards of management of a school are responsible for the appointment of teachers and other staff of a school and are, therefore, the employers of these individuals. The transitional agreement 2005 does not comprehend any change in this position.

Question 437: To ask the Minister for Education and Science if funding will be provided for Educate Together to enable it to fulfil its requirements as a registered patron for new schools, including writing, developing and implementing a patron's curriculum to be delivered in each school. Question 439: To ask the Minister for Education and Science if, in view of the fact that in the past five years Educate Together opened more schools than any other patron body, without assistance from the State, she will allow patron bodies to receive State aid in proportion to their activity in opening schools that are required and recognised by her Department. I propose to take Questions Nos. 437 and 439 together.

As I indicated in my statement on the publication of the Estimates for 2006, extra funding is being made available to the primary school management bodies. I am pleased to inform the Deputy that the funding being provided for Educate Together is being increased to €120,000. In addition, a grant of €10,000 payable in two instalments of €5,000 will be paid to the boards of management of newly establishing schools for training of the boards of management and staff in their initial years.

Schools established in the 2004-05 school year and which are now in their second year of operation will receive €5,000 as a training grant for boards of management. Those established in the current school year will qualify for both instalments of the grant.
