Question 418: To ask the Minister for Education and Science if she will ensure a person (details supplied) in Dublin 17 is not excluded from the redress board in December 2005; and if she will make a statement on the matter. [38815/05]

The person in question wishes to make an application to the Residential Institutions Redress Board regarding alleged abuse at a particular institution which is not included in the Schedule to the Residential Institutions Redress Act 2002. Section 4 provides that additions to the Schedule may be considered subject to it being established that the relevant institution was under inspection or regulation by the State or a State body. Section 4 states:

The Minister may, by order, provide for the insertion in the Schedule of any industrial school, reformatory school, orphanage, children's home, special school which was established for the purpose of providing education services to children with a physical or intellectual disability or a hospital providing medical or psychiatric services to people with a physical or mental disability or mental illness in which children were placed and resident and in respect of which a public body had a regulatory or inspection function.

As regards the institution for which the person in question wishes to apply for redress, officials at the Department of Education and Science checked the position on this institution with the Department of Health and Children. It has confirmed that it has no records which suggest that a public body inspected or regulated this institution. It is not possible, therefore, to include this institution in the Schedule and the redress board is not in a position to process an application in this case.
