Question 290: To ask the Tánaiste and Minister for Health and Children if the State, by providing different payments to service providers based purely on the economic means of the recipients of the service, is in keeping with the Equal Status Act 2000 and the Constitution; and if she will make a statement on the matter. I understand that the Deputy is referring to the fees and allowances paid to general practitioners in respect of services provided under the general medical services scheme. The level of these fees and allowances reflect the agreed outcome of negotiations between the Department of Health and Children, the Health Service Executive and the GP representative body, the Irish Medical Organisation. Such arrangements do not come within the scope of the Equal Status Act 2000.
