The person named has been notified that the circumstances outlined in his single payment scheme application for consideration of force majeure-exceptional circumstances satisfy the criteria laid down under Article 40 Council Regulation (EC) No. 1782/2003. The person named was notified on 14 March 2005 that years 2000 and 2001 would be excluded and the year 2000 would be utilised for the purposes of the calculation of his single payment entitlements. However, my Department has re-examined the medical evidence and is satisfied that force majeure circumstances should be applied in respect of the years 1999 to 2002 inclusive. Consequently, the single payment entitlements for the person named will be recalculated on the basis of 1997 and 1998. An amended statement of provisional entitlements reflecting this position will issue to the person named shortly.
