Question 619: To ask the Minister for Agriculture and Food if, as stated by An Taisce, her Department is not conforming to paragraph 13, Part V of SI 538 of 2001(details supplied) in view of the fact that to inform an objector may result in the loss of their statutory right to appeal within the legal timeframe available or to review such a decision through the courts within their strict timeframes. Under the consultation procedure operated under SI 538 of 2001 a specified statutory body or a member of the public may object to approval of an afforestation project in a designated environmentally sensitive area. Their observations and objections are taken into consideration in the deliberations of the forest service on the proposal.

If, following assessment, it is decided to approve the proposed afforestation, each of the parties who objected originally is notified in writing of the decision to proceed. The standard notification is made in full compliance with the provisions of paragraph 13 of the statutory instrument, including all prescribed information.
