Question 399: To ask the Minister for Education and Science if, in view of the correspondence regarding the pension entitlements of a person (details supplied) arrangements will be made to have the case of this person's pension entitlement re-examined; and if she will make a statement on the matter. The person in question does not hold relevant teacher qualifications and is employed as an unqualified regular part-time teacher in a secondary school. It has for many years been a condition for membership of the secondary teachers' superannuation scheme that the teacher should be fully qualified. The admission of unqualified teachers to membership of the scheme is being addressed by my Department in the context of the implementation of the provisions of the Protection of Employees (Part-time Work) Act 2001 and the Protection of Employees (Fixed-term Work) Act 2003. Schools will be advised of the appropriate arrangements in this regard following consultation with the relevant staff and management bodies. Following recent clarification by the Department of Finance of the application of the part-time work Act to public service pension schemes, my Department expects the consultative process will be completed within a matter of months.
