Question 389: To ask the Minister for Education and Science if a unit (details supplied) will be included in the schedule of institutions covered by the Institutional Residential Redress Act 2002, as provided for in the Act; and if she will make a statement on the matter. [28173/05]

Section 4 of the Residential Institutions Redress Act 2002 provides that the Minister may, by order, include in the Schedule to the Act any industrial school, reformatory school, orphanage, children's home, special school which was established for the purpose of providing education services to children with a physical or intellectual disability or a hospital providing medical or psychiatric services to people with a physical or mental disability or mental illness, in which children were placed and resident and in respect of which a public body had a regulatory or inspection function.

Officials of my Department consulted with the Department of Health and Children in regard to the unit referred to by the Deputy in order that records held at that Department and its agencies could be examined. My Department has received a response from the Department of Health and Children stating that it does not have any records which indicate that a public body had a regulatory or inspection function in regard to this unit. As a consequence, it is not possible to give further consideration to the placement of this unit in the Schedule.
