The visa application in question was received in my Department on 20 June 2005. When assessing any visa application, the visa officer will consider various matters, including whether it is reasonable in all the circumstances to conclude that the applicant would fully honour the conditions of the visa. For example, it is unlikely that the applicant would overstay the length of time applied for. Where previous visas have been granted to an applicant, my Department also examines whether the applicant adhered to the conditions of such visas. The visa officer will also have regard to information provided and to such factors as the applicant's ties and general circumstances in their country of origin.

The application in question was refused on 1 July 2005 as the applicant did not observe the conditions of a visit visa on a previous occasion. The application was the subject of an appeal by the applicant at which time additional information was supplied to my Department addressing the reason for refusal. However, the visa appeals officer was unable to conclude that the initial decision should be overturned. Consequently, the decision to decline the grant of a visa was upheld. As each application is entitled to only one appeal, no further review can be facilitated.
