Question 119: To ask the Minister for the Environment, Heritage and Local Government if he is satisfied that the EU directive on environmental impact assessment is being applied properly in the case of road plans, particularly the requirement to consider alternatives; and if he will make a statement on the matter. The improvement and maintenance of non-national roads in its area is a statutory function of each road authority in accordance with the provisions of section 13 of the Roads Act 1993. Under section 50 of the Roads Act 1993, as amended, road authorities are responsible for the preparation of environmental impact statements in respect of any relevant road development. Section 51 of the Act, as amended, sets out the position with regard to environmental impact assessments. Section 215 of the Planning and Development Act 2000 transferred responsibility for environmental impact assessments to an Bord Pleanála.
