Question 187: To ask the Minister for Justice, Equality and Law Reform the actions that have been taken to curb the pirating, renting, selling and other distribution of uncertified Indian films; and the action which will be taken with regard to this against the owner of a shop, details supplied, in Dublin regarding whom it is alleged that, despite previous conviction, continues such activity. I understand from the Garda authorities that the retailer concerned is in possession of a retail licence issued in accordance with the powers conferred on the official censor under section 18 of the Video Recordings Act 1989 to sell video recordings by retail or to let them on hire from his business premises. I am informed by the Garda authorities while the retailer referred to by the Deputy was the subject of a Garda investigation in 2002 leading to a court conviction, no complaints have been received since then. I am further informed that the Garda Síochána monitors outlets in accordance with the Video Recordings Act 1989 and where breaches of the law are detected, appropriate action ensues.
