Question 156: To ask the Tánaiste and Minister for Health and Children the number of additional cases for the repayment of illegal nursing home charges that have been taken against her Department or the HSE since the Supreme Court decision of 16 February 2005; and if she will make a statement on the matter. There are currently 42 cases being taken relating to nursing home charges in publicly funded long-term residential care. I intend to bring legislation before the Oireachtas in the autumn which will provide a clear legal framework for a repayments scheme for those who were unlawfully charged. This will ensure that repayments are made as promptly as possible. The scheme will also allow for repayments to be made to the estates of all those who were charged but who died in the six years prior to 9 December 2004.
