Question 157: To ask the Minister for Communications, Marine and Natural Resources if he is satisfied that no person who is disqualified from holding a directorship of a private company is currently a member of any State board under the auspices of his Department; and if he will make a statement on the matter. Part VII of the Companies Act 1990 provides for the restriction and disqualification of directors and others of private companies under certain circumstances. The Registrar of Companies is obliged to maintain a register of disqualified persons, having being notified by the court registrar when the court grants a restriction or disqualification order against an individual. Based on the information contained in this register I am satisfied that none of the names on it corresponds to those of members of the boards of any of the State-sponsored bodies under the aegis of my Department.

I am requesting the chairpersons of the State-sponsored bodies under the aegis of my Department to ensure that I am informed in the future in the event of a board member being disqualified from holding directorship of a private company.
