Question 413: To ask the Minister for the Environment, Heritage and Local Government if he has plans to issue guidelines governing availability of and accessibility to toilet and changing facilities in retail outlets, especially for persons with disabilities; and if he will make a statement on the matter. Part M of the building regulations access for people with disabilities, which applies to all new buildings and extensions to or material alterations of existing buildings commenced on or after 1 June 1992, requires that adequate provision shall be made to enable people with disabilities to safely and independently access and use a non-domestic building including a retail outlet. Part M requires that where sanitary conveniences are provided in a building, adequate provision shall be made for people with disabilities. Technical guidance document M, TGD M, published by my Department, provides guidance on how to comply with the requirements of part M. The outline sectoral plan for my Department and local authorities published under the Disability Bill 2004 includes a commitment to initiate a review of part M and TGD M by the end of this year. Following the enactment of the Disability Bill changing facilities will be considered as part of that forthcoming review.
