The Health Act 2004 provided for the Health Service Executive which was established on 1 January 2005. Under the Act, the executive has the responsibility to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. As the person referred to by the Deputy resides in County Kilkenny, my Department has requested the chief officer for the executive's south eastern area to investigate the matter and reply directly to the Deputy.

Question 168: To ask the Tánaiste and Minister for Health and Children further to Question No. 243 of 2 November 2004, and the subsequent meeting arranged with the regional chief executive of the ERHA, the reason for the refusal of treatment on two separate occasions and the refusal to clarify information as requested regarding treatment undertaken in 2002; and if arrangements will be made to correct inaccuracies in the medical records of this case. The Health Act 2004 provided for the Health Service Executive which was established on 1 January 2005. Under the Act, the executive has the responsibility to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. This includes responsibility for the functions of the former Eastern Regional Health Authority. Accordingly, my Department has asked the chief officer for the Health Service Executive's eastern regional area to investigate the position with the matters raised by the Deputy and to reply directly to him.

Meetings have already taken place to attempt a resolution of this case. A further meeting is due to take place today between the individuals concerned and my special adviser.
