Question 224: To ask the Tánaiste and Minister for Health and Children if a person (details supplied) in County Cork who paid maintenance charges at a geriatric type hospital while in continuing care for a period of six months is entitled to a refund of all or part of the charges as they are a medical card holder and an old age pensioner. The details of a repayment scheme to address the situation following the Supreme Court decision are currently being finalised and it is only following this that it would be possible to calculate accurately the amount of repayment due to an individual.

The Health Act 2004 provided for the Health Service Executive which was established on 1 January 2005. Under this Act, the executive has the responsibility to manage and deliver, or arrange to be delivered on its behalf, health and social services. This includes responsibility for the issue raised by the Deputy and, accordingly, my Department has requested the HSE to investigate the matter and apply directly to the Deputy.
