Question 174: To ask the Tánaiste and Minister for Health and Children if interest will be applied in the return of moneys illegally taken from elderly nursing home patients over many years with the same vigour as when health boards sought the return of previous superannuation benefits; if the interest will be compounded at 7% p.a. on moneys taken prior to 1 January 1987 and at 6% thereafter; and if she will make a statement on the matter. My Department is currently studying the Supreme Court judgement in relation to repayment of charges for publicly-funded long term residential care in detail and will take on board all the consequences for policy and law arising from the judgment. A special Cabinet sub-committee comprising the Taoiseach Mr. Ahern, the Minister for Finance Mr. Cowen, the Attorney General Mr. Brady and myself has been established to consider the issue of repayment in light of the judgment. Full details of a repayment scheme will be announced as soon as possible and it is the intention to make repayments as automatic as possible.
