Question 74: To ask the Minister for the Environment, Heritage and Local Government if he has completed his consideration of the European Court of First Instance decision to rule against Ireland for failure to protect human health through properly controlling waste dumps; the steps he is taking the ensure that Ireland will in future comply with the European Commission's waste disposal directive; and if he will make a statement on the matter. The opinion of the Advocate General is still under consideration but until such time as the judgment of the European Court of Justice is available in the coming months it would not be appropriate to comment on this matter. If the court finds that a member state has failed to fulfil an obligation under the European Treaty the state concerned is required to take the necessary measures to comply with the judgment.
