Question 103: To ask the Minister for Communications, Marine and Natural Resources the reason An Post acted illegally by charging a person (details supplied) in Dublin 5 the new 2004 rate for their television licence, which expired on 31 December 2003; the position regarding renewal notices; and if he will make a statement on the matter. Under the Postal and Telecommunications Services Act 1983, An Post acts as my agent in the collection of television licence fees. Accordingly, day-to-day administration matters are the responsibility of An Post.

I can confirm for the Deputy that the regulations governing television licence fees provide that when a television licence is renewed, that the fee payable is the fee that is in force on the date the payment is made. Accordingly, in the case of a licence that was renewed from 1 January 2004 the fee would have been €152.
