As Senator McDowell said, people should not have it both ways. The Bill does not restrict people's constitutional right to go to the courts. They can go to court, but if they buy into this system that is what they do. It has been agreed that there should be a referee whose decision should be accepted. There is a danger, as Senator McDowell said, of the stronger party, the people who are used to this type of process, suddenly upping the stakes and starting all over again.
