Construction Contracts Bill 2010: Second Stage (Resumed)

Let me recap on some of the points I made. The level at which the legislation is pitched is much too high and needs to be much lower. A small trader, for example, could be badly caught out if payments were not made in respect of a number of different sub-contracts.

Given that the Government intends to enact this Bill, how does it intend to enforce it? There is not much point in enacting it unless there is a means of enforcing it.

The third issue I want to raise concerns the ability of the Office of the Director of Corporate Enforcement. It is intended to be part of the enforcement regime and it inquires into fairly significant matters. A resource issue arises as a consequence. I would like this dealt with, if possible, in the Minister's summation as it is extremely important.

Those who end up receiving the first judgments in the court are those who seem to do best. This means that those farther down the food chain, who do not have the ability to go to court, fare least well.
