I wish to raise the contentious issue of the large number of women throughout the country who are involved in custody battles and find themselves forcibly removed from their children, sometimes arrested, sometimes imprisoned, and sometimes this happens to their children likewise. I want to ascertain to what extent efforts can be made to dislodge the use of a pseudo-condition introduced by an American some years ago, which is totally alien to this country and is reminiscent of what happened in prisoner-of-war camps, so this activity of parental alienation can be suspended indefinitely in order to allow a full investigation into what is going on.

Parental Alienation is not a pseudo condition otherwise why is your Government Department of Justice currently writing a paper on PA at the present time and how is it that there are over 1000 peer reviewed papers on this issue. Also Parental Alienation is in Irish Jurisprudence in Irish Family Case & ECHRC Law. So all those Judges are engaging with a "pseuedo-condition"? I do not think so. What about the fathers rights Bernard? Women and Men commit abuse and their are many alienated mothers as well as fathers in Ireland who you are dismissing nevermind thousands of children and their grandparents. Please visit alienated.ie

Also Bernard please read AB v CD [2011] IEHC 543 Mr. Justice Abbott Irish evidence to the contrary - What is your evidence? how many women are being "forcibly removed"? How many are being "imprisoned" and what is the gender balance on your figures of fathers and mothers? Where is the proof of what you say? is it from SISI? If so they incorrectly state that "While some men experience domestic abuse, 96% of victims are women." when official government stats give 66% approximately and it is well known that many more men are too embarrassed to report being abused and these figures do not yet include victims of parental alienation abuse.

Also womensaid in their own report on PA reported that (this is parental alienation and it is like all abuse undertaken by both genders sadly) "In Women’s Aid Direct Services experience most women with children, particularly from age 7/8+,
report attempts by fathers to ‘turn the kids against her’. Women have reported to us throughout
the years that the abuser often tells children lies about their mothers; denigrates her to the
children, undermines her authority and manipulates the children against her. For example, by
using children to spy on the mother and report to him or by encouraging them to join in the
verbal or even physical abuse of the mother.
Children end up blaming her for his abusive behaviour and align themselves with the father
against her.
Women feel deeply upset by the weaponisation of their children, and while these tactics are by
no means always successful many women can be really undermined.
In some cases, women told us that the relationship with their children has broken down
completely and has not resumed even when the children are adults. In other cases women felt
they had to cut off contact with one or more of their older children because their father had
‘poisoned them’ so much that their own mental health was being seriously compromised by
contact with their children.

This common emotional abusive tactic is often commonly employed as an integral part of an
abuser’s overall coercive control pattern and has long been recognised by domestic violence
services and described in Domestic Violence literature.37
In our experience this form of abuse against mothers, and children, is usually ignored in the
Family Courts.

As are all false allegations so should we stop the use of domestic abuse in family courts too. Or should we allow trained judges and professionals decise if a child is being alienated from a parent or not. Womensaid do not deny the existance of parental alienation in their submission to government they actuallly cite research that explicity
in your "Submission on Parental Alienation June 2022 state " - we regularly hear from women experiencing domestic abuse that the perpetrator
actively undermines the bond between the mother and the children both before, during and after
separation.
In Women’s Aid Direct Services experience most women with children, particularly from age 7/8+,

Women’s Aid believes that in both scenarios where women are falsely accused of Parental
Alienation and where children are manipulated to ally with an abusive parent, the broader
context of a power imbalance, Coercive Control and complex abusive tactics need to be taken into
account to provide adequate and safe responses." All Parental Alienation campaigners agree that all false allegations must be addressed as it is a form of abuse as should parental alienation. Is womensaid saying that only women experience parental alienation and even if they feel this way why are they not supporting alienatted mothers grandmothers and daughters? Are they being selective about who is a victim? Parental Alienation Campaigners have Zero Tolerance against all abuse whether against Children Females or Males are Women's Aid?

Thank you for recognising parental alienation exists and now is the time to join the campaign to address this form of Child Abuse and Coercive Control that affects mostly children and parents and grandparents of BOTH GENDERS

So are women's aid against parental alienation (child abuse & coercive control) being addressed or not? And if so how? when it exists it cannot be disregarded. Where are your Irish Statistics that support your case " our experience this form of abuse against mothers, and children, is usually ignored in the Family Courts." Because if this was true there would be no alienated mothers, fathers, grandparents or especially alienated children. Where is your proof that experienced Judges disregard Domestic Abuse that is legislated for in favour of Parental Alienation that is not legislated for? Your assumptions are not making any sense.

Judge describes case as ‘parental alienation’
A judge has described a case in which a mother was accused of using the COVID-19 pandemic as an excuse to deny her ex-partner access to their son as a case of ‘parental alienation’.

Estranged
The term describes a process through which a child becomes estranged from a parent as the result of the psychological manipulation of another parent.

It is believed to be the first time the term has been recorded in court.

Judge Mary Larkin was making an order at the Family Law Court in Ennis on Thursday, according to a report by Gordon Deegan in the Irish Examiner.

Judge Larkin directed earlier this month, before the 2km Covid-19 restriction was introduced, that the mother provide access of their 12-year-old to his father before Thursday's court date.

But solicitor for the father, Frank Doherty, stated on Thursday that his client will have been denied access to his son 26 times during April and May.

The couple are estranged and live a number of miles apart at different houses in Co Clare.

Jail warning for breach of access
Judge Larkin warned the mother: “I have no difficulty sending someone to jail for breach of access. This is a breach of a court order and you have to comply with court orders.”

In court, the mother stated that she tried to provide access on Friday 10 April, but at the planned handover at an Applegreen service station, she said that her son was upset and didn’t want to go with his father.

Video accusation
The father accused the mother of trying to video the Applegreen encounter on her phone and the mother denied trying to do so.

In her order, Judge Larkin ordered that until the lifting of the COVID-19 lockdown on May 5, the boy and his father were to have daily ‘Facetime’ access.

Access days
The judge added that after the lockdown has been lifted, the father was to resume access and all of the access days lost over recent weeks were to be made up over the summer.

Judge Larkin said she was seriously concerned about this child’s ongoing mental health if the situation continued.

She also ordered that the child engage with a child psychotherapist. and Judge 'seriously concerned' as mother accused of using Covid-19 as 'excuse' to stop dad's access

A mother has been accused of using the Covid-19 pandemic as an excuse to deny her ex-partner access to their son.

Solicitor for the father, Frank Doherty made the charge at the Family Law Court in Ennis today after stating that his client will have been denied access to his son 26 times during April and May.

Earlier this month at the family law court before the 2km Covid-19 restriction was introduced, Judge Mary Larkin directed that the mother provide access of their 12-year-old to his father before today's court date.

The couple are estranged and live a number of miles apart at different houses in Co. Clare and Judge Larkin warned the mother: “I have no difficulty sending someone to jail for breach of access. This is a breach of a court order and you have to comply with court orders.”

The mother told the court that she was denying access because “the HSE is telling us not to mix with other people - that is why I am protecting my family from people coming into my house from other houses”.

In court today, the mother stated that she tried to provide access last Friday, April 10, but at the planned handover at an Applegreen service station, she said that her son was upset and didn’t want to go with his father.

The mother denied that the access is not occurring as a result of Covid-19 and said that her son doesn’t want to see his father.

The father today accused the mother of trying to video the Applegreen encounter on her phone and the mother denied trying to do so.

In her order, Judge Larkin has ordered that until the lifting of the Covid-19 lockdown on May 5, the boy and his father are to have daily ‘Facetime’ access.

Judge Larkin told the boy’s mother: “You are not promoting a relationship with his father…. I’m not really satisfied that the grounds of refusing access are credible.”

You need to explain to your child that he needs to see his father - everyone has to have a relationship with their father.

“It occurs to me that this is a case of parent alienation.”

Parental alienation describes a process through which a child becomes estranged from a parent as the result of the psychological manipulation of another parent.

Judge Larkin said: “A child of 12 should not be estranged from either his mother or father and I am seriously concerned about this child’s ongoing mental health if this continues.

“There is huge psychological pressure on this child.”

“If your child was to suddenly not want to see you, you would be heartbroken and if your child went to live with his father, you would be devastated.

You have to have some regard that your ex-partner has feelings and love for his son just as you have.

“I feel really, really feel sorry for this child. He is a complete victim of his parents’ incapacity to act as parents and to put the interests of their child first and not always think ill of the other.

“This is a child who very much needs his parents to stop it. The saddest thing is neither of them can see that the ultimate damage is being done to this child and whether it is irreparable at the moment, I can’t decide."

“Can’t you both not see how the toxicity of your relationship has damaged and poisoned your child in his adolescence?”

The court heard the ongoing issues between the parents concerning their son commenced in 2011 when he was aged just two and Judge Larkin said: “If it continues I will get the Child and Family Agency (CFA) involved because I am concerned about the child’s mental health.”

Addressing the attempt at court ordered access last Friday, Judge Larkin told the mother: “The effort at access of winding down the window of a car is totally inappropriate and bound to be unsuccessful.”

Addressing the mother, Judge Larkin said: “When your son says 'I don’t want to see Daddy’ did it ever occur to you to say to him ‘you’re a child, you do what you’re told and don’t go on about your father like that'? You have to assert yourself. You are the parent and he is the child.”

I realise 21 did not comment does this mean she has no evidence of what he/she says?

If she does comment she might like to say what she thinks of this case over 9 years ago where a Judge acted on Parental Alienation and outlined how it should be addressed with a methodology that could have saved many children lives from this horrendous abuse. https://ie.vlex.com/vid/b-v-c-d-793384161
