There have already been exclusions for competition law for recognised producer organisations in particular if the farmers have concentrated supply through this recognised producer organisation. However, with this new exclusion even someone who is not a farmer, does not have a recognised producer organisation and is not concentrating their supply through this recognised producer organisation may enter into a collective agreement with a processor without fear of being subject to investigation by the competition authorities.
