To follow up on that, there is always a risk, even though it might be a slim one, of losing a court action. Ms McNamara said that if the State was underpinning this entity it would be open to major risks. I take that to mean financial risks. So far I can only see this applying to the CCPC. Are there other organisations that might apply to be qualified entities? Would they have the resources behind them to absorb legal costs if a case went against them? Would they be allowed to take a case in the first place if they did not have substantial financial resources behind them?
