I move amendment No. 7:

In page 15, between lines 4 and 5, to insert the following:

“Repeal of sections 13 and 14B of Principal Act

12. Sections 13 and 14B of the Principal Act are repealed.”.

This amendment repeals sections 13 and 14B of the principal Act. Section 13 of the Competition Act 2002 lays down rules on the admissibility of evidence. New rules on the admissibility of evidence are being put in place by means of the new section 15AW for inclusion in the Competition Act 2002. The new rules are required to fully transpose the ECN+ directive.

In the interests of removing the potential for any confusion or overlap of the provisions in the future, amendment No. 7 repeals section 13. Amendment No. 7 also repeals section 14B from the Competition Act 2002. This section deals with applications to the High Court for orders in relation to certain agreements. There is provision in the Bill to deal with these agreements, and again in the interests of removing the potential for overlap or confusion, section 14B is being repealed.
