Joint Oireachtas Committee on Justice, Defence and Equality

General Scheme of the Judicial Appointments Commission Bill 2020: Discussion

Dr. Patrick O'Brien:

I have one small point based on how the conversation has gone in the last 15 or 20 minutes, which is I want to push back against the idea diversity in the Judiciary has to wait on diversity in the profession. That is not to disparage anything the representatives of the professions have said.

These are different issues and it is possible to have a more diverse Judiciary without waiting, as a former judge of the Supreme Court of the United Kingdom called Jonathan Sumption said, when he indicated it would take 50 years to wait for gender diversity. We do not have to do that. We can have separate conversations and judicial diversity. Without wishing to disparage what anyone else has said, these do not all have to be part of the same conversation.
