My understanding is that while there is a requirement for intent to cause harm or to be reckless as to whether harm is caused in the distribution of the message in paragraph (a) of the offence, there is no requirement in respect of paragraph (b), which is what Deputy Carroll MacNeill has said is considered problematic.
