Yes. We follow formal well developed procedures that have been built up over decades of experience within the organisation. We are operating in a legal context that is very much evolving. We have new directives and requirements. Case law will alter the thresholds or tests. When legal advice indicates that a case will be challenging, we make a judgment. Normally when we concede a case, it is remitted to the board, but different decision-makers look at it. We make sure our processes are fully up to speed. In these cases that is a better option than going to the courts. The issue is not cost but time. The amount of lead-in time required to obtain court dates, even in the commercial courts, stretches out the process. It probably undermines people's confidence in the system.
