We can always open a public interest investigation under the current legislation, but that is often well after the horse has bolted. For example, I read recently about a case where a garda had been returned for trial in the Circuit Court. There would be no point in opening a public interest investigation when the DPP has already directed a prosecution and the matter is before the courts.
