There is an interaction of two systems here. There is the system of financial services regulation, which has a role to play. There is also contract and property law and the role of the courts. There are two interactions here. Some of the issues to which the Senator refers might be particular to the wording of a particular contract. In general terms, one would want to take both of the interactions into account in giving an answer. If the contract is silent, there are other legal mechanisms that operate.
