Influence of Social Media on Elections and Referenda: Discussion

I beg the Deputy's pardon. I omitted to answer that question. We receive, on an ongoing basis, a lot of complaints from employees in organisations, and ex-employees of organisations, particularly around CCTV monitoring of individuals, and our annual reports each year detail case studies where individuals allege that they have been subject to inappropriate and excessive monitoring by their employers around CCTV. We have also received complaints from individuals, within the employment context, that their emails were accessed without their knowledge and we have investigated those particular cases.

There is quite a body of case law from the European Court of Human Rights around the issue of employer monitoring of employees in the workplace and the rights to privacy and to data protection that employees still retain in the workplace, notwithstanding the legitimate interest of employers to operate their business effectively.

If the Deputy is interested, we can provide him with a summary of the case law in that area and some of the case studies that we have published in relation to decisions we have made.
