Joint Oireachtas Committee on Children and Youth Affairs

Cybersecurity for Children and Young Adults: Discussion (Resumed)

9:30 am

Ms Niamh Sweeney:

It might be useful to highlight that we publish a transparency report every six months, which covers a breakdown by country of requests we have had from law enforcement and how the request has been responded to. That includes a breakdown of preservation requests from the Garda. In an instance like that where as Ms Cummiskey said sharing the content might not be illegal but the actual act taking place would be illegal, the Garda Síochána may take a case and they would reach out to us through the dedicated contact point in the Phoenix Park and they would ask us to preserve that content so that they can avail of it for any prosecution that may take place. In the six months to December of 2016, we had 109 preservation requests covering 157 accounts. There are other types of requests that we would facilitate around basic subscriber information that the Garda may need to recall. We would have data on the percentage of requests from the total number of accounts that would have been affected and it is around the 80% mark. We try to be as transparent as we possibly can.
