Joint Oireachtas Committee on Justice, Defence and Equality

General Scheme of the Data Protection Bill 2017: Discussion (Resumed)

9:00 am

Mr. T.J. McIntyre:

I will make one point on that. Some of the confusion that will stem from the structure of this is due to the fact that the GDPR is an independent instrument. The national variations and flexibilities as regards aspects of the GDPR mean that people are necessarily looking to two texts. As a practical matter rather than a legislative matter, it would be very helpful were the Office of the Data Protection Commissioner or the Department of Justice and Equality to publish, after this process is over, a consolidated document that would include the text of the GDPR and, after each article of the GDPR, the relevant provisions of Irish law that give effect to, derogate from or take advantage of the flexibility of each aspect.
