I move amendment No. 5:

5. In page 16, between lines 25 and 26, to insert the following: “Definitions

20.In this Part—

“sexual act” means—

(a) an act consisting of—

(i) sexual intercourse, or

(ii) buggery,

(b) an act described in section 3(1) or 4(1) of the Act of 1990, or

(c) an act which if done without consent would constitute a sexual assault; “sexual intercourse” shall be construed in accordance with section 1(2) of the Act of 1981.”.

This amendment amends section 20 of the Bill which provides a definition of sexual act. The meaning of sexual intercourse has been added to the existing definition in the Bill and replicates the definition of sexual act under the Criminal Law (Sexual Offences Act 2006).
