First and foremost, the liability rests with the developer. The Deputy is correct that the developer, the McNamara organisation, is gone. There is no right of recourse to the developer. We are currently quantifying the scale of the cost and investigating where the liability can arise. Behind the scenes there are still some avenues that we can pursue. As not everybody is gone, there is a right of recourse in some cases. On behalf of the State we will follow any third party that should have been held accountable to ensure accountability. Liability will rest somewhere between the State and the owners of the property in that development.
