Civil Registration (Amendment) Bill 2014: Committee Stage

Section 25 introduces a number of provisions to combat civil partnerships of convenience to make such civil partnerships more difficult to contract in the future. A list of criteria that the registrar will consider when forming an opinion that a proposed civil marriage is one of convenience is set out in this section.

The section also allows for the registrar to receive an objection stating that the proposed civil partnership consists of a civil partnership of convenience and in forming the opinion there are grounds for the objections to refer the matter to the superintendent registrar for a decision. The request to produce documented evidence will assist the registrar in forming an opinion as to whether a proposed marriage or civil partnership is one of convenience. We are concerned about the entering into a marriage or a civil partnership solely for the purpose of securing migration advantage. That is an important element of the Bill.

The Deputy's amendment No. 5 to section 21 proposes that when deciding which documents and information to seek, the Registrar General shall take into account the particular circumstances of the individual in question. That relates to the point the Deputy was making. The registrar who will be operating those procedures is very experienced and deals with persons from a diverse range of cultures and circumstances on a daily basis. The policy in regard to seeking documentary evidence will be operated in line with the principles of natural justice. Does that reassure the Deputy?
