Mr. Mark Kelly:

Our view would be that the current incitement to hatred legislation is extremely weak and difficult to operate in practice and there have rarely, if ever, been successful prosecutions even in flagrant cases of incitement to hatred so we think that is something that needs to be looked at. There is then the broader issue of looking at hatred as an aggravating factor, for example, in the context of sentencing. That is what my colleague Mr. Jayawardene referred to as an area at which we are now looking as an organisation for a specific research project.
