I thank Mr. Fennell for his contribution, which highlights again one of the problems with Europe, namely, the marked divergence between the common law system in place in Britain and Ireland on the one hand and the civil law jurisdictions on the other. It is clear we cannot opt in to the regulation given the substance of Article 8.
