Joint Oireachtas Committee on Finance, Public Expenditure and Reform

Bank Charges: Discussion with Central Bank and ISME

4:00 pm

Mr. Bernard Sheridan:

I imagine it does apply but the Central Bank is not involved in the case. From our perspective, we would ask if the code applied to the sale. If so, a consumer would have the right under our consumer protection code to lodge a complaint with the institution. That right applies irrespective of when a consumer bought his or her product provided that the code was in place at the time.

We see more of a problem around the right to complain to the Ombudsman. The Statute of Limitations issue is not something in which the Central Bank plays a role or is involved with. The question is whether there is a gap in financial services rather than examining the Statute of Limitations.
