General Scheme of the Garda Síochána (Recording Devices) (Amendment) Bill: Discussion
Dr. Nessa Lynch:
On the point about the difference between an intelligence match and evidence in court, I think it is probably worth comparing this again to other types of biometrics such as DNA and fingerprints. A motoring offence is maybe a little bit different because that is probably intrinsic to the proof of the offence. However, for a serious criminal offence, obviously DNA and other biometrics will go to prove that the person was there at the particular time, or the identification. Certainly, like DNA evidence, it is not going to help with proving mens reaor other elements of the criminal offence. There is the idea that the normal rules of evidence for a serious criminal offence, and the standard of proof, are still going to have to be met. However, I definitely agree with the points made about accuracy.
