Regulation 188 in MiFID says that a person is guilty of an offence and shall be liable on summary conviction to a fine not exceeding €5,000 or a term not exceeding 12 months if the person contravenes a provision of these regulations. Why then does Ms Rowland tell me that a breach of these regulations is not a criminal offence?
