Joint Oireachtas Committee on Justice, Defence and Equality

General Scheme of Data Protection Bill 2017: Discussion

9:50 am

Mr. Seamus Carroll:

As far as I am aware, this is not typically the type of work that is done by supervisory authorities. Some supervisory authorities may already have the power to impose penalties, including administrative fines. However, when it comes to compensation, I am not aware that supervisory authorities have such power. This is typically the kind of work carried out by courts.

Obviously, there may be bodies such as the Injuries Board, which has a role. The Injuries Board has an adjacent role to the courts when it comes to awarding compensation. I do not have sufficient information on the position in other member states to say more.
