179. To ask the Minister for Education and Skills the measures being taken to backdate pay increases for Section 39 workers funded outside the HSE, particularly those under her Department; to provide clarification on the reason some section 39 workers have only received a partial funding for backpay related to 2023 and none for 2024, while remaining on the pre-WRC agreement pay scale; and if she will make a statement on the matter. I wish to advise the Deputy that under the provisions of the Health Act 2004, the Health Service Executive (HSE) may enter into agreements with, and provide funding, to voluntary agencies (section 38 and 39 organisations) to deliver services on its behalf.

The Workplace Relations agreement referred to in this question relates to Section 39 workers employed by voluntary agencies, and who are funded by the HSE via the vote of the Department of Health and the vote of Department of Children Equality Disability Integration and Youth Affairs.

Questions in relation to increases in pay for Section 39 workers should therefore be referred to the HSE, or to the Department of Health and the Department of Children Equality Disability Integration and Youth Affairs.
