To ask the Tánaiste and Minister for Justice and Equality further to Parliamentary Question No. 503 of 5 March 2024, why GDPR was not given as a reason for data withholding, if it was known at the time of answer that GDPR was an issue; if so, from what date; and the reason it was not referenced. As the Deputy will be aware, the Garda Commissioner is responsible for the management and administration of Garda business under Section 26 of the Garda Síochána Act 2005 (as amended). This includes resource management for the service.
I am informed by the Garda authorities that they can confirm that GDPR was not, at any point, a factor when responding to the Deputy's previous query. The reason, as stated in the previous response, that information cannot be provided is that it would require a disproportionate expenditure of Garda time and resources to compile.
