To ask the Minister for Employment Affairs and Social Protection whether any social welfare payment administered by her Department would be lost by a claimant in the event of them changing their gender, from male to female or from female to male, under the provisions of the Gender Recognition Act 2015; and if she will make a statement on the matter. Social Welfare payments, both benefit and assistance, are generally based on specific contingencies such as pregnancy, illness, unemployment, age etc. Where a person is in receipt of such a benefit or allowance, they will have met the criteria around the payment and therefore, a change of gender under section 8 of the Gender Recognition Act 2015, would not cause a payment to be lost.
