195. To ask the Minister for Health if he has examined reclassifying large section 39 organisations, which are core service providers in partnership with the HSE, as section 38 organisations; if he has examined the potential cost of such a measure; and if he will make a statement on the matter. There is no process being considered to reclassify Section 39 with those on a S38 contract and therefore no costings are available.

It is worth noting that Section 39 are not public bodies, and the terms and conditions of employment for staff in these organisations are ultimately between the employer and the employee. Although we are not the employers, the Department is aware that staff employed across the hundreds of funded organisations have been employed using a multiplicity of terms and conditions, including different rates of remuneration and are dependent on Government for funding
